CHICAGO: Houston-based Shell Pipeline has agreed to pay a 105-thousand dollar civil penalty and donate 50-thousand dollars to a recycling program for dumping contaminated soil in a Kane County landfill.

 

The agreement with the Illinois attorney general's office resolves a September 2004 lawsuit filed by Lisa Madigan in Kane County Circuit Court.

 

The lawsuit claimed soil found last year to be contaminated from a 1988 gasoline release was disposed of at Settler's Hill Recycling and Disposal Facility in Geneva.

 

The facility was not licensed to accept hazardous waste, and Shell Pipeline did not inform Settler's Hill it was disposing of such waste.

 

Shell Pipeline now ensures the state it is in compliance with all environmental laws and regulations. The company no longer operates the pipeline between St. Louis and Chicago.
